1 Agreement to these Terms

Welcome to Lvaara. These Terms of Use (“Terms”) apply to your use of our website, online store, content and services (collectively, the “Site”). By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and our related policies.

2 Eligibility

You may use the Site only if you:

• are competent to contract under applicable Indian law; and
• use the Site for lawful personal or permitted business purposes; and
• provide accurate information when registering or checking out.

If you use the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3 Your account

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

• Keep your password secure and do not share it
• Notify us promptly of unauthorised use
• Ensure your profile, phone and address details stay up to date

We may suspend or terminate accounts that violate these Terms, show abusive behaviour, or present fraud/risk concerns.

4 Acceptable use

You agree not to:

• use the Site for any unlawful, harmful, fraudulent or abusive purpose;
• attempt to gain unauthorised access to systems, data, or other users’ accounts;
• scrape, harvest, or bulk-extract content/product data without permission;
• interfere with Site security, performance, or integrity (malware, bots, overload attacks, etc.);
• misrepresent your identity, affiliation, payment method, or delivery details;
• post unlawful, defamatory, obscene, or infringing content in reviews or forms;
• use our brand, packaging, or product images to run misleading ads or counterfeit listings.

We reserve the right to investigate and take appropriate action, including order cancellation and legal remedies where warranted.

5 Products, descriptions & availability

We aim to display products, notes, images and pricing accurately. However, fragrance experience is subjective, screen colours may vary, and product packaging or formulations may be updated over time.

• Product pages are for general information and shopping guidance
• Availability is not guaranteed until an order is accepted and confirmed
• In rare cases of listing errors, we may cancel and refund affected items
• Always review ingredients/usage guidance if you have sensitivities and patch-test when advised

6 Orders, pricing & acceptance

When you place an order, you make an offer to purchase. Order confirmation communications acknowledge receipt; acceptance and fulfilment depend on verification, stock, pricing accuracy, payment success and serviceability.

Pricing

• Prices are shown in Indian Rupees (INR) unless stated otherwise
• Taxes, shipping and offers are calculated at checkout where applicable
• Promotional codes are subject to their own rules and may be withdrawn

Order issues

We may refuse or cancel orders in cases of suspected fraud, abuse of offers, address/payment failures, stock unavailability, or force majeure events. Prepaid amounts for cancelled undeliverable orders are refunded as per policy timelines.

7 Payment terms

Payments are processed through third-party payment gateways / methods shown at checkout (for example UPI, cards, net banking, wallets, and COD where available).

• You represent that you are authorised to use the selected payment method
• COD availability depends on pin code, cart value and risk checks
• Failed or incomplete payments may prevent order confirmation

8 Shipping, cancellation & returns

Delivery timelines, free-shipping thresholds, packaging and tracking are described in our Shipping Policy. Cancellation windows and return eligibility (including hygiene rules for opened fragrances) are described in Cancellation & Returns.

Those policy pages form part of your overall agreement with Lvaara for purchases made on the Site.

9 Intellectual property

The Lvaara name, logos, product names, packaging designs, website design, text, graphics, photographs, videos and other content on the Site are owned by or licensed to Lvaara Fragrances and are protected by applicable intellectual property laws.

• You may browse and shop for personal, non-commercial use
• You may not copy, modify, distribute, sell, or exploit Site content without prior written permission
• Product images and brand assets for press use should follow our Press guidelines/request process

10 Reviews, messages & user content

If you submit reviews, questions, feedback or other content, you grant Lvaara a non-exclusive, worldwide, royalty-free licence to use, display and distribute that content in connection with our business and marketing, subject to applicable law and our moderation standards.

You agree not to post content that is false, unlawful, abusive, infringing, or that discloses others’ private information.

11 Third-party services & links

The Site may link to third-party websites, payment providers, courier tracking pages, maps, or social platforms. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

12 Disclaimer of warranties

The Site and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by law. While we work to keep the Site secure and accurate, we do not warrant uninterrupted access, error-free operation, or that the Site will meet every expectation.

Fragrance perception varies by skin chemistry, climate and personal preference. Descriptions and notes are guides, not guarantees of individual experience.

13 Limitation of liability

To the maximum extent permitted under applicable law, Lvaara and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Site or products, except where liability cannot be excluded by law.

Where liability cannot be excluded, it shall be limited to the amount you paid for the specific product/order giving rise to the claim, to the extent permitted by law.

14 Indemnity

You agree to indemnify and hold harmless Lvaara Fragrances and its team from claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your misuse of the Site, violation of these Terms, or infringement of any right of a third party — to the extent permitted by applicable law.

15 Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and process personal information (such as order and contact details). Please review it carefully.

16 Changes to the Site or Terms

We may update the Site, products, offers and these Terms from time to time. The “Last updated” date will change when material revisions are published. Continued use of the Site after updates constitutes acceptance of the revised Terms, except where applicable law requires additional consent.

17 Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer protections, courts in Delhi, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Site.

Nothing in these Terms limits rights that cannot be waived under mandatory consumer protection laws.
